Non-Resident Alien |
|
|
Individuals residing outside the United States and qualifying as U.S. non-resident aliens are able to take advantage of certain investment advantages. You are disqualified if you are holding a "green card" and are considered a lawful permanent resident or if you meet the "substantial presence test". |
![]() |
Substantial Presence is met when an individual is present within the United States for:
| 183 or more days during the current calendar year, or | |
| More than 31 days during the current calendar year and a total of more than 183 days including the current year, one-third of the days during last year and one-sixth of the days during the year before last. |
Example:
A client living outside the U.S.A. spent the following
number of days in the U.S. during the last three years:
| Year 1 | 120 |
| Year 2 | 117 |
| Year 3 | 126 |
To calculate whether he meets the substantial presence test, we would make the following calculations:
The client, for tax purposes, is only considered to have been within the United States for 180 days over the past three years and does not meet the substantial presence test. Therefore, Dover can manage his account to its full advantage in order to maximize his after-tax yield.
